Abstract

The subject matter of this paper can be traced back to the systematic study of crime. From the vintage of criminal justice–considering an ever growing number of social relations– we must establish in which cases can the outcome of our actions be said to imply legal consequences. To this end, we may consider several alternatives arising from the theory of crime. Either from the causal nexus point of view (basically an ontological view), or from a normative view, setting axiological criteria to the responsibility imputation from actions and establishing when can they be taken as cause in a particular ontological environment. The second alternative offers a more solid and systematic approach to the cases. It also helps to develop a rational systematic consideration of crime, allowing no impunity holes. Moreover, it will contribute to a guarantee criminal law, effective and rooted to human relations.
